heads up musicians… bob marley OM, (estate) vexed after all these years…
…For better or worse, a record deal consists of a handful of certainties. One such certainty is that your label, whether major or indie, will own thesound recordings created under your deal. But can a label own your music’s copyright? In most instances, the answer is “no,” but this is not always the case. In a September 2010 decision, the U.S. District Court for the Southern District of New York held that the estate of Bob Marley did not hold the copyrights to music contained in five of Marley’s most popular records. The legal basis: Marley signed a contract providing that his albums were the “absolute property” of his record label. Essentially, the court determined that his albums, and the underlying compositions they contained, were “works made for hire” under the United States Copyright Code.fyi,… this is the same court that awarded clutch and gwar ownership of all their master (sound recordings) recordings/ dvd’s originally released by drt entertainment in a september 2009 ruling in favor of plaintiff. those cases were based on record company default on settlement agreement, not copyright ownership,

…the issachar/ weathermaker/ clutch/ slave pit music family has lost a dear friend. our lives will never be the same. every weathermaker record released in the uk/ europe/ and australia had his hand print on it. steve also brokered the deals to get the last two GWAR records licensed to the uk/ europe and australia as well. just so you know.our deepest condolences go out to the propas family.
respectfully i post mention from his home country…
> R.I.P.: Longtime music industry veteran Steve Propas passed away from heart problems yesterday evening, Aug. 2, aged 63. Perhaps best known as one of two partners (with Neill Dixon) in the groundbreaking Canadian ’80s indie label Solid Gold Records, Propas went on to write his own ticket in the music industry, finding a lucrative niche in the licensing and branding industry. His area of specialty gave him a ticket to travel the world where he developed a network of international contacts that was second to none in this country. He is survived by his wife Monica Miller, son Michal and daughter Debora. The funeral is Friday at 1:00pm at Steeles Memorial Chapel, 350 Steeles Avenue West – Thornhill. Interment at Bathurst Lawn Memorial Park, First Narayever Section. Shiva will be observed at his home. Donations may be made in Steven’s memory to the Jordan Propas Camp Fund c/o UJA Federation 416-631-5833.
